Design Extension/Renewal
In India the Designs protected for the period of 10 years from the priority date, after the design is registered in India. In case you wish to extend the period of your design registration, then as per the Indian IP laws, you can extend the period of your design registration for 5 years by filing an application along with prescribed fees to the controller. The application has to be filed before the expiry of initial 10 years.
Further, in case you fail to make an application for extension of registration period, then you can also file an application for restoration of your design by paying prescribed fees, within the period of 1 year from the date your design was lapsed.
