International Trademark Application

Filing an application for registration of trademark in multiple countries together is facilitated by Madrid protocol which is administered by WIPO. There are currently 99 countries that are part of Madrid protocol.

In other words, you can apply for trademark registration in 99 countries together through Madrid protocol. However the procedure for getting registration through Madrid protocol is a complex and lengthy procedure.

In this firstly you have to apply an application in Indian trademark office who will forward the application to WIPO. Once the application is filed in WIPO, WIPO will examine the application for errors and if the errors are found, WIPO will communicate it to the applicant and will provide the applicant with three months to rectify it.

Once the changes are made by the applicant, WIPO will register the mark and will publish the mark in WIPO gazette and will provide the applicant with international registration. After that WIPO will forward the application to the countries where you want to apply for registration. After receiving your application, those countries will again examine your application, and will communicate the acceptance or refusal of your application to WIPO within 12 to 18 months.

If the mark is accepted, then you will get the protection for your trademark for the period of 10 years.

We at Delhi IP have Trademark attorneys who assist our clients in filing and registering their mark in different countries through Madrid protocols. We also assist our clients in case an objection is raised by WIPO by filing an appropriate reply.
